Rule 4.05.9. These include: <br /> • Sediment ponds(see discussion above) <br /> • Stock ponds for watering of cattle and wildlife (see Exhibit 7, Item 15 of the PAP) <br /> • Water treatment basins <br /> • The Taylor Pump Holding Pond (which existed prior to August 3, 1977) <br /> • The Wilson Storage Pond (see Exhibit 7,Item 23 of the PAP) <br /> In previous years, stock ponds were added to the reclamation plan with TR-87, approved on March <br /> 25, 2011 and with TR-89, approved March 18, 2011. These stock ponds have been constructed, and <br /> locations are shown on Maps 12 and 12B of the PAP. <br /> G. Ground and Surface Water Monitoring -Rule 4.05.13 <br /> The surface and ground water monitoring plan is presented in Section 4.05.13 of the PAP,and results <br /> are reported in quarterly Discharge Monitoring Reports and Annual Hydrology Reports. Monitoring <br /> includes discharges from sediment ponds, a requirement of Colowyo's CDPS permit with the WQCD <br /> (a division within CDPHE). It also includes in-stream monitoring and sampling of streams in the <br /> permit and adjacent area, monitoring and sampling of alluvial wells, and monitoring of water levels <br /> in wells (piezometers) on fills. <br /> H. Transfer of Wells -Rule 4.05.14 <br /> No transfer of wells is proposed. All monitoring wells will be reclaimed prior to bond release. <br /> I.Water Rights and Replacement -Rule 4.05.15 <br /> Colowyo has demonstrated that no owner of a vested water right is proximately injured. <br /> J. Discharge of Water into an Underground Mine-Rule 4.05.16 <br /> In Colowyo's operations plan,no surface water will be discharged into underground mine workings. <br /> K. Stream Buffer Zones-Rule 4.05.18 <br /> The Division approved surface or underground mining activities within 100 feet of or through a <br /> perennial stream or stream with an aquatic community. This decision was based on a finding that <br /> the original stream channel will be restored,water quality and quantity shall not be adversely affected, <br /> and appropriate riparian vegetation will be reestablished. The buffer zone variance is granted for <br /> portions of Good Spring Creek near the sediment ponds which discharge into that creek (Streeter <br /> Pond, Gulch A Pond and Prospect Pond), a portion of Taylor Creek near the loadout and an elevated <br /> water pipe line crossing over the Taylor Creek near the intersection of <br /> 34 <br /> Permit Revision No.5(PR-05),G 1981-019 <br />
