documents the reevaluation and update of previous findings as necessary to reflect changes
that have occurred during the current permit term(February 25, 2023 to present) and the
changes proposed with PR-05. Any stipulations that have been resolved, to the satisfaction
of the Division, have been removed from this document.
Section A- Findings Required by Rule 2.07.6(2)
1. Accuracy and Completeness.
The Application is accurate and complete, and in compliance with all requirements of the
Act and these Rules.
ll. Feasibility.
Based on information contained in the Application and other information available to the
Division, the Division finds that surface coal mining and reclamation can be feasibly
accomplished at the Colowyo Mine [in compliance with Rule 2.07.6(2)(b)].
Ill. Cumulative Impacts.
The assessment of the probable cumulative impacts of all anticipated coal mining in the
general area on the hydrologic balance, as described in Rule 2.05.6(3), has been made by
the Division. This assessment, entitled "Yampa River Cumulative Hydrologic Impact
Statement," was completed in May 2010. A subsequent memorandum was written based on
the Collom project (PR-03) on December 1, 2011. These documents are available for
inspection at the offices of the Division. Based on these documents and given that the
changes to the post mining land use proposed with PR-05 does not pose potential for
impacts on the hydrologic balance on and adjacent to the Colowyo Mine permit boundary,
the Division finds that the operations proposed under the Application have been designed to
prevent material damage to the hydrologic balance outside the proposed permit area [in
compliance with Rule 2.07.6(2)(c)]. See Section B. III (Probable Hydrologic
Consequences) of this findings document for additional discussion of the predicted
hydrologic consequences of mining operations at the Colowyo Coal Mine.
IV. Unsuitable Areas,Prohibitions and Limitations
The Division finds the affected area is subject to valid rights existing as of August 3, 1977 and is
described in the following subparagraphs.
A. Areas Designated Unsuitable
The affected area is not within an area designated unsuitable for surface coal mining operations (Rule
2.07.6(2)(d)(1))-
26
Permit Revision No.5(PR-05),G 1981-019
