(Bestway)to BURNCO. <br /> Background <br /> The mine site is at 32744 County Rd 13, Windsor, CO 80550 in Weld County, Colorado west of the Town of <br /> Windsor. More specifically, the site is within part of Section 19, Township 6 North, Range 67 West of the 6th <br /> Principal Meridian. Mining at the site is complete. Site area is 278.6 acres. <br /> The site was permitted in 1983 by La Poudre Sand &Gravel Co, then transferred to Hall-Irwin Corporation, <br /> and then in 2012 to Bestway. In 2017, Bestway and BURNCO merged into one entity. Both entities have the <br /> same ID Number of 20171214623 as shown on the Secretary of State's website as of October 7, 2025. <br /> Succession of Operator <br /> Enclosed are the documents required for the transfer: Application Form (Attachment 1), Performance <br /> Warranty (Attachment 2), and Financial Warranty (Attachment 3). BURNCO believes that a Legal Right to <br /> Enter and Structure Agreements are not required to be updated. When Company A transfers a site to <br /> Company B, it is necessary and appropriate that the Right to Enter and Structure Agreements be updated <br /> to reflect the new owner. In the case of Bestway/BURNCO, this is unnecessary because Bestway and <br /> BURNCO are both Company A. The main intent is for the new operator to assume all liability for the mining <br /> operation, which has taken place as the financial warranty is in BURNCO's name. Other pertinent <br /> documents enclosed are: 2017 Certificate of Merger (Attachment 4) and Secretary of State Information <br /> (Attachment 5). <br /> We appreciate your review.
