October 5, 2025
To: Jocelyn L. Carter
Division of Reclamation, Mining and Safety RECEIVED
From: James and Joseph Grisenti OCT 0 2025
12000 State Highway 115 . jiarado Division of Reclamation,
Penrose, CO 81240 Mining and Saftey
gr_isentig@aac_o_m
719-371-3262
Ref: Grisenti Farms Gravel Pit—File No. M-2001-005, Continental Materials
Corporation Surety Release Request(SL-1)
We have no objection to the surety being released but we do have concer
ns to be
addressed before it is done.
1. Weir for Phase 2 Pit. The corporation has purchased the weir and put in the pipe
but has not installed the weir. Currently we are augmenting this pond as required
with the water being put into Phase 1 Pit. It is acceptable to use to continue this if
the Division of Water Resources advises it meets their requirements. If the DWR is
agreeable to us using this process to augment both ponds,we would need it in
writing so that in the future we are not required to pay for the installation of this weir
or any remote monitoring equipment.
2. Augmentation. Currently Bishop Brogdan is the DWR contact for the pond
augmentation. We would need to be the designated contact and to have access to
the remote monitoring of the weir or weirs to be used for any augmentation. And to
receive instruction on how to maintain the remote monitoring device. Our contacts
at Bishop Brogdan have advised they could advise us how to do this.
3. Reseeding. We are still waiting to be reimbursed for the reseeding.
4. Lien. The property lien must be released.
Please let us know if there is anything additional or clarification you need from us.
1-4
James Grisenti, Senior Partner
