Box 191 <br />Victor, CO 80860 <br /> <br /> <br />Re: Decision Document - Approved with Conditions <br /> Amendment AM14 - VLF2 Phase 4 and VLF1 Phase 6 expansions <br /> Cresson Project, Permit No. M-1980-244 <br /> <br />Dear Bjorn Meyer: <br /> <br />On October 1, 2025, the Division of Reclamation, Mining and Safety (Division) concluded its review <br />of the Amendment application (AM14) submitted to the Division on April 25, 2024, and considered <br />filed for review on October 1, 2024, addressing the following: <br /> <br />Extend the life of mine to 2049 by adding 189 million tons of leach capacity through <br />construction of Phase 4 of the Valley Leach Facility (VLF) 2 and Phase 6 of VLF1. AM14 <br />also proposes the expansion of the Globe Hill Pit. Lastly, AM14 includes an expansion of the <br />affected lands boundary by 14.2 acres for the construction of an employee parking lot and <br />0.63 acres for a monitoring well access road. <br /> <br />The decision reached by the Division is: Approve with Conditions. <br /> <br />Condition 1: <br /> <br />The Operator will implement the recommendations outlined in the 2025 VLF 2 High Process <br />Water Event Summary Investigation, as agreed upon between the Division and the Operator, <br />to revise the permit and improve the VLF facilities and also, if necessary, modify the designs <br />for VLF1 Phase 6 and VLF2 Phase 4, for the protection of the environment and compliance <br />with the Rules and Act. <br /> <br />The terms of AM14 approved by the Division are hereby incorporated into Permit No. M-1980-244. <br />All other conditions and requirements of Permit No. M-1980-244 remain in full force and effect. <br /> <br />The revised liability amount exceeds the financial warranty currently held (see below), please submit <br />additional bond or a rider to your existing bond that equals or exceeds the Revised Liability; in <br />accordance with Rule 4.2.1(2), an additional bond amount of at least $2,480,348.00 is due within 60
