Sievers Pit M-77-098 SWSP, Oldcastle SW Group, Inc. Page 8 of 13
September 30, 2025
Oldcastle will replace all lagged depletions created by expanded mining activity at the
Sievers Pit during the worst-case downstream scenario for the Cameo Call, with the call
period running from April through November of each year (Table 3), using a combination of
consumptive use credit from the dry-up of irrigated lands of the Kaiser-Sievers Ditch as
decreed in Case No. 83CW65 and a lease with WDWCD.
Pursuant to Case No. 83CW65, a total of 22.1 acres of historically irrigated lands have been
dried up as a result of the gravel mining operation, resulting in a consumptive use credit of
32.5 acre-feet during the May 5t" through October 10t" time period. These credits are not
sufficient to replace the increased depletions from the Sievers Pit under this SWSP,
therefore the remaining replacements will be provided by releases from WDWCD totaling 6.0
acre-feet per year (Table 3). These releases include a 10% transit loss. The Applicant
currently has a perpetual lease of 29.1 acre-feet per year with the WDWCD under Contract
No. 090521 LW(a), attached. The Applicant has obtained a new WDWCD lease for 6.0 acre-
feet annually upon approval of this SWSP. The sources of replacement water from WDWCD
have been identified as Ruedi Reservoir, Green Mountain Reservoir, Alsbury Reservoir, or
other sources available to the District.
The attached "Sievers Gravel Pit Water Balance" table shows that total proposed lagged
depletions at the pit are 31.07 acre-feet, which exceeds the 26.1 acre-feet of depletions
contemplated in the 83CW65 decree. The water balance indicates that the 32.50 acre-feet
of HCU credits from 83CW65 and 6.0 acre-feet of WDWCD water, accounting for the
projected call scenario, are sufficient to replace all out-of-priority depletions at the pit.
Conditions of Approval
This SWSP is hereby approved in accordance with section 37-90-137(11), C.R.S., subject to
the following conditions:
1. This SWSP is approved with the effective date of July 1, 2025, and shall be valid
through June 30, 2027, unless otherwise revoked. If this plan will not be made
absolute by a water court action by the plan's expiration date, a renewal request
