<br />REFERENCE ONLY. SLIGHT INACCURACIES MAY OCCUR IN SPECIFIC AREAS DUE TO THE

<br />WHICH CORRESPONDS TO THE INTERSTATE 25 EASTERN RIGHT-OF-WAY AND LARIMER
<br />COUNTY ROAD 36, RESPECTIVELY. THE NORTHERN PERMIT BOUNDARY IS CONSISTENT WITH
<br />THE SOUTHEAST QUARTER OF SECTION 3 NORTHERN QUARTER -SECTION LINE. THE WEITZEL
<br />ROAD EXTENSION AND ASSOCIATED RIGHT-OF-WAY WERE RELEASED FROM PERMIT AREA
<br />(DRMS APPROVAL LETTER DATED DECEMBER 13, 2023) AND ARE NO LONGER WITHIN THE
<br />TIMNATH CONNELL PIT PERMIT AREA.
<br />4. APPROVED REVISIONS TO THE ORIGINAL PERMIT AREA (M-1999-050) INCLUDE GROUNDWATER
<br />RECHARGE POND GEOMETRY, LANDSCAPE BERMS, BELOW -GRADE LINED RESERVOIR
<br />GEOMETRY, THE WEITZEL ROAD EXTENSION, THE RELOCATED BOX ELDER DITCH, AND THE
<br />WEITZEL ROAD EXTENSION RIGHT-OF-WAY AREA AND RELEASE FROM THE PERMIT
<br />BOUNDARY.
<br />5. FOR PROPERTY OWNERSHIP, IT IS IMPORTANT TO NOTE THAT THE PROPERTY OWNER IS
<br />CONNELL LLC. THIS IS DIFFERENT FROM CONNELL RESOURCES, INC., THE MINE OPERATOR AND
<br />APPLICANT. ALL MANMADE STRUCTURES ON THE SITE INCLUDING WATER CONVEYANCE
<br />INFRASTRUCTURE, STRUCTURES ASSOCIATED WITH MINING AND RECLAMATION ACTIVITIES,
<br />AND FENCES AND GATES ARE OWNED BY THE APPLICANT AND NOT THE PROPERTY OWNER.
<br />6. PROPERTY LAND USES SURROUNDING THE TIMNATH CONNELL PIT INCLUDE HISTORIC
<br />AGGREGATE MINING, RURAL RESIDENTIAL, COMMERCIAL, AND FUTURE
<br />RESIDENTIAL/COMMERCIAL DEVELOPMENT. THE TIMNATH CONNELL PIT PERMIT PROPERTY
<br />WAS HISTORICALLY IN UNINCORPORATED LARIMER COUNTY AND WAS INITIALLY ZONED
<br />FARMING (FA-1), AND MORE RECENTLY RURAL RESIDENTIAL (RR2). HOWEVER, THE PROPERTY
<br />HAS BEEN ANNEXED INTO THE TOWN OF TIMNATH AND THE CURRENT TOWN ZONING IS
<br />REGIONAL COMMERCIAL (RC). THE RC DISTRICT IS DESCRIBED AS BEING LOCATED SOLELY AT,
<br />OR NEAR THE INTERCHANGES OF INTERSTATE 25 AND ARTERIALS. THE RC DISTRICT IS
<br />DESIGNED TO FACILITATE AN APPROPRIATE MIX OF REGIONAL COMMERCIAL USES SUCH AS
