Revised 9/25/2025 for Technical Revision <br /> EXHIBIT A <br /> Legal Description <br /> The proposed amendment area is a tract of land located within the Town of Timnath (recent <br /> annexation), Larimer County, Colorado. The proposed permit area includes 151.3 acres <br /> currently includes 121.4 acres following the approval of AR-2 in August 2025. <br /> According to the Larimer County Assessor's Office, the amendment area parcels are owned by <br /> Connell LLC. <br /> The site is the location of an active aggregate mining and processing operation. The property has <br /> been annexed into the Town of Timnath and the current town zoning is Regional <br /> Commercial (RC). The RC zoning district includes regional commercial uses such as large retail <br /> establishments, business and light industrial uses, medical facilities and offices, higher density <br /> multi-family residential, and a continuum of life-care housing options. This Timnath Connell Pit <br /> amendment proposes to change the final reclamation plan to include opportunities for future <br /> development consistent with the established Timnath zoning district and the property owner <br /> preferences. <br /> Quarter, quarter section description of the Proposed Permit Amendment Area: <br /> Southeast quarter (SE'/4) of Section Three (3), Township Six North (T6N), Range Sixty-Eight <br /> West (R68W) of the Sixth Principal Meridian(6th P.M.), County of Larimer, State of Colorado. <br /> Latitude/Longitude of main entrance: <br /> The Timnath Connell Pit revised primary site entrance shall be onto the Weitzel Road extension. <br /> 410.512220 N 40.51320 N <br /> 104.98311e-W -104.98620 <br /> Description of Proposed Amendment Permit Area: <br /> The Weitzel Road extension is a public roadway dedicated to the Town of Timnath that bisects <br /> the 1999 permit boundary. The Weitzel Road extension provides public access between Larimer <br /> County Road 5 (LCR 5) to the east and Harmony Road (via off-site Weitzel Road) to the north. <br /> The Weitzel Road extension area was released from within the Timnath Connell Pit permit area <br /> on December 13, 2023 (Acreage Release Request 1), as described in the attached letter from the <br /> Colorado Division of Reclamation, Mining and Safety (DRMS). The release reduced the <br /> Timnath Connell Pit permit area by approximately 6.3 acres from 157.6 acres to 151.3 acres. <br /> Further, the approval of AR-2 in August 2025 removed an additional 29.9 and made the total <br /> permit area 121.4 acres. <br /> parts: the reclaimed northeast corner (Acreage Release Request has not yet been submitted to the <br />
