Revised 9/25/2025 for Technical Revision EXHIBIT A Legal Description The proposed amendment area is a tract of land located within the Town of Timnath (recent annexation), Larimer County, Colorado. The proposed permit area includes 151.3 acres currently includes 121.4 acres following the approval of AR-2 in August 2025. According to the Larimer County Assessor's Office, the amendment area parcels are owned by Connell LLC. The site is the location of an active aggregate mining and processing operation. The property has been annexed into the Town of Timnath and the current town zoning is Regional Commercial (RC). The RC zoning district includes regional commercial uses such as large retail establishments, business and light industrial uses, medical facilities and offices, higher density multi-family residential, and a continuum of life-care housing options. This Timnath Connell Pit amendment proposes to change the final reclamation plan to include opportunities for future development consistent with the established Timnath zoning district and the property owner preferences. Latitude/Longitude of main entrance: The Timnath Connell Pit revised primary site entrance shall be onto the Weitzel Road extension. 410.512220 N 40.51320 N 104.98311e-W -104.98620 Description of Proposed Amendment Permit Area: The Weitzel Road extension is a public roadway dedicated to the Town of Timnath that bisects the 1999 permit boundary. The Weitzel Road extension provides public access between Larimer County Road 5 (LCR 5) to the east and Harmony Road (via off-site Weitzel Road) to the north. The Weitzel Road extension area was released from within the Timnath Connell Pit permit area on December 13, 2023 (Acreage Release Request 1), as described in the attached letter from the Colorado Division of Reclamation, Mining and Safety (DRMS). The release reduced the Timnath Connell Pit permit area by approximately 6.3 acres from 157.6 acres to 151.3 acres.
