Phase II release on 11.7 acre of Dryland pasture, and Phase III on 157 acres of Irrigated Pasture and <br /> Dryland Pasture. <br /> SL-23 was received on September 26, 2019. SL2-23 approved Phase III bond release of a reclaimed <br /> ditch, with a post-mining land use of irrigated pasture. The reclaimed ditch accounted for 0.4 acres. <br /> No objections were received regarding SL-23. SL-23 was approved on March 19, 2020, and released <br /> $2,361.00 in reclamation liability. <br /> SL-24 was received on January 28, 2021. SL-24 approved Phase I, II, and III bond release of Stock <br /> Pond I (SP1), previously known as the Goforth Stock pond, and the immediate surrounding area, <br /> consisting of approximately 1.1 acres. SL-24 was approved on May 13, 2021, and released $5,675.00 <br /> in reclamation liability. <br /> SL-25 was received on May 16, 2022. SL-25 approved Phase I, II and III bond release for nine (9) <br /> plugged and abandoned monitoring wells, and two (2) plugged and abandoned backfill wells. SL-25 <br /> also approved Phase I release on 24.5 acres, Phase II release on 11.4 acres. SL-25 was approved on <br /> February 15, 2023 and released $52,098.00 in reclamation liability. <br /> SL-26 was received on August 15,2023. SL-26 approved Phase I, II and III release of Stock Pond SP- <br /> 2 and the C-15 Ditch. The Revision approved the Phase I, II and III release of 0.1 acres associated <br /> with the C-15 Ditch and 1.7 acres were approved for Phase II and Phase III release associated with the <br /> SP-2 stockpond. In total 1.8 acres were Phase III released. SL-26 was approved on January 10, 2024 <br /> and released$10,560.00 in reclamation liability. <br /> SL-27 was received on January 15, 2024. SL-27 approved Phase I release of 85.5 acres that were <br /> backfilled and graded in 2023. The release was for Dryland Pastures DP-18, DP-20 and DP-21. Also <br /> included was the Irrigated Pasture IP-12 and the Prime Farmland PF-I. SL-27 was approved on June <br /> 19, 2024 and released $167,002.00 in reclamation Liability. <br /> SL-28 was received on February 29, 2024. The bond release approved Phase I, II and III release of 5 <br /> monitoring wells and 7 exploration holes. There is no acreage associated with the request for the 5 <br /> groundwater monitoring wells and 7 exploration holes. SL-28 was approved on July 24,2024. <br /> An application for a full Phase III bond release, SL-29,was received by the Division on May 28, 2025. <br /> The application was deemed complete on July 2,2025, after the Division received proof of publication <br /> of the applicant's public notice. Elk Ridge Mining and Reclamation, LLC published the notice of the <br /> bond release application in the San Miguel Basin Forum once a week for four consecutive weeks, <br /> beginning on June 4, 2025 ERMR also notified landowners within and adjacent to the mine permit <br /> area, and other interested parties of the application for the bond release, as required by Rule 3.03.2(1). <br /> No comments, written objections, or requests for an informal conference regarding the bond release <br /> application were received by the Division during the initial publication and comment period. <br /> The bond release inspection was conducted on July 23, 2025. The site inspection was conducted in <br /> accordance with Rule 3.03.2(2). The Division was represented during the inspection by Clayton Wein. <br /> Tony Tennyson represented ERMR.
