Holcim South Platte Combined SWSP September 18, 2025 <br /> Plan IDs 3614, 4773, 3624, 4772, 4616, 3437, 3376, 3650, 3668, 5475, 5829, &t 6243 Page 31 of <br /> 37 <br /> device utilized in this plan must be provided in a timely manner acceptable to all of <br /> the water commissioners identified herein. <br /> 15.Prior to using a downstream replacement source for upstream depletions, or prior to <br /> operating any administrative exchange, the Applicant shall be required to provide 48 <br /> hours advanced notice and obtain prior approval from the Water Commissioners. In <br /> addition, the Applicant will coordinate deliveries of changed shares back to the river <br /> from the Whitney Ditch, the Fulton Ditch, and the Greeley Irrigation Canal with the <br /> Water Commissioners. Holcim will track and provide the amount of water available, <br /> the amount of water requested, and the amount of water delivered on a daily basis or <br /> as required by the water commissioner. Any use of downstream replacement sources <br /> for upstream depletions, or any operation of an administrative exchange, can only <br /> operate when there is sufficient streamf low and no intervening call for water within <br /> the impacted reach. <br /> 16. In order to prevent injury to other water rights, the division engineer and water <br /> commissioner must be able to administer Applicants' replacement water past <br /> headgates on the river at times when those headgates would otherwise be legally <br /> entitled to divert all available flow in or "sweep" the South Platte River or its <br /> tributaries. Applicant shall not receive credit for replacement of depletions to the <br /> South Platte River or its tributaries below such diversion structures unless bypass and <br /> measurement structures are in place to allow the division engineer and water <br /> commissioner to confirm that Applicant's replacement water is delivered past the <br /> headgates. In the event that delivery past dry-up points requires the use of a <br /> structure for which a carriage or use agreement with a third party is required, <br /> Applicant shall be responsible for securing such agreement. Until such time as the <br /> Applicant provides a copy of the carriage or use agreement to the division engineer <br /> and water commissioner, no credit will be allowed for replacement of depletions to <br /> the South Platte River or its tributaries below such diversion structure. <br /> 17.The Division of Water Resources will not be responsible for any enforcement or <br /> administration of third party agreements that are not included in a decree of the <br /> water court. <br /> 18.The name, address, and phone number of a contact person who will be responsible for <br /> the operation and accounting of this plan must be provided to the Water <br /> Commissioner(s) and the Division Engineer. <br /> 19. Subject to prior approval by the division engineer, the Applicant may lease or <br /> purchase additional replacement water as identified in this SWSP request. Such <br /> additional sources of replacement water may only be used in this SWSP if the <br />
