<br />Dear Sir or Madam:
<br />
<br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34,
<br />Article 33, Section 118, Paragraph 3, of the Colorado Revised Statutes, that on September 16, 2025,
<br />an application to revise coal mining operations at the Deserado Mine was considered complete for
<br />the purposes of filing. All review and comment periods as provided in the Act and the Regulations
<br />initiate from this date of filing.

<br />Deserado Mine is requesting permission to construct and operate a slurry injection system to backfill
<br />mined out workings. The applicant is not proposing additional surface disturbance outside of the
<br />area currently approved for disturbance.
<br />
<br />The underground coal mining operation is on land located approximately 7 miles Northeast of
<br />Rangely, Colorado. The permit area is further described as follows:
<br />
<br />Portions of Sections 1, 2, 3, 4, 10, 11, and 12, T2N, R101W, 6th PM, all in Rio Blanco County;
<br />Portions of Sections 17, 18, 19, 20, 21, 23, 25, 26, 27, 28, 30, 31, 34, 35, and 36, T3N, R101W, 6th
<br />PM; All of Sections 22, 29, 32, and 33, T3N, R101W, 6th PM, all in Rio Blanco County.

<br />The above-mentioned tracts of land are shown on the following USGS 7.5 minute Quadrangle
<br />map(s): Rangely Ne.

<br />This application as submitted may not constitute a Mining Plan Action. If the proposal is
<br />significantly changed during our review process, we will consult with you on whether a Mining Plan
