Cunningham, Director <br />September 12, 2025 <br />Steve White <br />Montrose County Planning & Development <br />Director <br />63130 LaSalle Road <br />Montrose, CO 81401 <br />Re: New Horizon Mine (Permit No. C-1981-008) <br />Permit Revision Application No. 10 (PR-10) <br />PR-10 Permit Boundary and Post Mine Land Use <br />Dear Montrose County Planning & Development: <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, <br />Article 33, Section 118, Paragraph 3, of the Colorado Revised Statutes, that on September 12, 2025, <br />a permit revision application for a permit to conduct coal mining operations, Permit No. C-1981-008 <br />by Elk Ridge Mining and Reclamation, LLC, was considered complete for the purposes of filing. <br />All review and comment periods as provided in the Colorado Surface Coal Mining Reclamation Act <br />and the Rules and Regulations of the Colorado Mined Land Reclamation Board for Coal Mining <br />initiate from this date of filing. <br />PR-10 proposes to increase the permit boundary and revises the post mine land use. The applicant <br />is not proposing additional surface disturbance outside of the area currently approved for <br />disturbance. <br />The surface coal mining operation is located approximately 1.7 miles Northwest of Nucla, Colorado. <br />The permit area is further described as follows: <br />All or portions of the following: <br />Sec 6, T46N, R15W: NE 1/4 NE ¼; W ½ NW ¼ NE ¼; SE ¼; <br />Sec 1, T46N, R16W: N ½ NE ¼ NE ¼; NW ¼ NE ¼; NW ¼ SE ¼ NE ¼; <br /> NE ¼ NW ¼; N ½ SE ¼ NW ¼
