ASPINALL STORAGE UNIT <br /> LONG-TERM WATER SERVICE CONTRACT BETWEEN <br /> THE UNITED STATES <br /> and <br /> OLDCASTLE SW GROUP dba <br /> UNITED COMPANIES OF MESA COUNTY <br /> (UNITED COMPANIES) <br /> THIS CONTRACT, made this e7 Z/ day of 5 gp 1JEm,b Q,j'' , 2007, pursuant <br /> to the Act of Congress approved June 17, 1902 (32 Stat. 388), and acts amendatory thereof or <br /> supplementary thereto, and particularly pursuant to the Colorado River Storage Project Act <br /> approved April 11, 1956 (70 Stat. 105), between THE UNITED STATES OF AMERICA, <br /> hereinafter referred to as the United States, represented by the officer executing this contract, his <br /> duly appointed successor or his duly authorized representative, hereinafter referred to as the <br /> Contracting Officer, and United Companies, hereinafter referred to as the Contractor, <br /> WITNESSETH: <br /> WHEREAS, the following statements are made in explanation: <br /> (a) The United States has constructed Blue Mesa Dam and Reservoir as a unit of the <br /> Colorado River Storage Project, for the furnishing of water for irrigation, municipal, and other <br /> beneficial uses; and <br /> (b) The Contractor has requested a water service contract for 5.0 acre-feet of municipal <br /> and industrial water stored in Blue Mesa Reservoir; and <br /> (c) The Contractor's point of use shall be in SE 1 A of the SE 1 A, S W 1 A of the SE 1 A and <br /> the SETA of the SWIA of Section 36 in Township 48 North, Range 9 West and NEIA of the <br /> NEIA Section 1 in Township 47 North, Range 9 West,New Mexico PM; and <br /> (d) The Contractor desires a water supply stored at Blue Mesa Dam for augmentation of <br /> depletions resulting from evaporation, dust control and material removal on gravel mining <br /> operations pursuant the Contractor's plan of augmentation has been applied for with the District <br /> Court in Water Division 4. <br /> 1 <br />
