An enforcement hearing was scheduled before the Mined Land Reclamation Board <br />(“MLRB” or “Board”) during the August 20-21, 2025, Board meeting regarding this matter. On <br />August 1, 2025, the Division received and approved your extension request to extend the due date for <br />the surety increase revision (SI1) to September 1, 2025. On August 1, 2025, the Division also sent a <br />Notice of Continuance notifying you that the matter was continued to the September 17-18, 2025 <br />MLRB hearing. On September 7, 2025 the Division received your extension request to extend the <br />due date for the surety increase revision (SI1) to October 1, 2025. The Division approved the <br />extension request on September 8, 2025. <br />This notice is to inform you that the enforcement hearing scheduled before the MLRB is being <br />continued. The enforcement hearing is now scheduled during the October 15-16, 2025 Board <br />Meeting for consideration of this possible violation. The hearing will be held in Room 318 of 1313 <br />Sherman Street, Denver, Colorado, beginning at 9:00 a.m. on October 15, 2025 or as soon thereafter <br />as the matter can be considered. At that hearing you will have the opportunity to present your defense. <br />If the Division receives and accepts the required surety increase by October 1, 2025 the enforcement <br />hearing may be withdrawn. <br />The Board’s agenda for the October 15-16, 2025 meeting may not be finalized until the week of the <br />Board meeting. Therefore, we recommend you contact the Board’s Secretary Camille Mojar, at <br />(303)-866-3567, extension 8136, on October 13, 2025 to confirm the specific date for the hearing.
