Page 8 of 12 <br /> August 7, 2025 <br /> perpetual lease of 29.1 acre-feet per year with the WDWCD under Contract No. <br /> 090521 LW(a), attached. The Applicant will obtain a new WDWCD lease for 6.0 acre-feet <br /> annually upon approval of this SWSP. The sources of replacement water from WDWCD have <br /> been identified as Ruedi Reservoir, Green Mountain Reservoir, Alsbury Reservoir, or other <br /> sources available to the District. <br /> The attached "Sievers Gravel Pit Water Balance" table shows that total proposed lagged <br /> depletions at the pit are 31 .07 acre-feet, which exceeds the 26.1 acre-feet of depletions <br /> contemplated in the 83CW65 decree. The water balance indicates that the 32.50 acre-feet <br /> of HCU credits from 83CW65 and 6.0 acre-feet of WDWCD water, accounting for the <br /> projected call scenario, are sufficient to replace all out-of-priority depletions at the pit. <br /> Conditions of Approval <br /> This SWSP is hereby approved in accordance with section 37-90-137(11), C.R.S., subject to <br /> the following conditions: <br /> 1. This SWSP is approved with the effective date of July 1, 2025, and shall be valid <br /> through June 30, 2027, unless otherwise revoked. If this plan will not be made <br /> absolute by a water court action by the plan's expiration date, a renewal request <br /> must be submitted to this office with the statutory fee (currently $257) no later <br /> than April 1, 2027. <br /> 2. Total consumption at the Sievers Pit site must not exceed the exposed <br /> groundwater surface area or depletion amounts above, as shown on attached <br /> Tables 1-3 and "Sievers Gravel Pit Water Balance" table, unless an amendment is <br /> made to this SWSP. <br /> 3. Approval of this SWSP is for the purposes as stated herein. This office must first <br /> approve any additional uses for the water. Any future additional historical <br /> consumptive use credit given (e.g., agricultural water transfer) for this site must <br /> consider all previous credits given. <br />
