This consent is in response to the request from Mr. Steve Kelton,representing <br /> Brannan Sand and Gravel Company,requesting said continuance pursuant to the attached Delivery Schedule <br /> that modifies the original Delivery Schedule. <br /> Extension of the Agreement for additional Lease Years is permitted under Paragraph 1 of the Agreement. <br /> Further,the Delivery Schedule for water under the Agreement may be modified and replaced pursuant to <br /> Paragraph 2 of the Agreement. The modified Delivery Schedule attached to this letter replaces the Delivery <br /> Schedule attached as Exhibit A to the Agreement. The Effective Date of the Agreement for the purposes of <br /> this additional Lease Year is the date of this letter.
