Graham, <br /> <br />The Division of Reclamation, Mining and Safety (Division) has reviewed the responses to the Division’s first Notice <br />of Filing Deficiencies for your Hardrock Limited Impact Operation 110(1) Reclamation Permit Application for the <br />proposed “Open Pit” operation, File No. M-2024-035. Pursuant to Rule 1.4.1(8), the Division has determined the <br />application still contains deficiencies which prevent the application from being considered filed. Please respond to <br />this Notice of Filing Deficiencies 2 with the requested information and summarize each response to the numbered <br />items below, in a cover letter titled “Response to Notice of Filing Deficiencies 2, M-2024-035”. <br /> <br />Application Form and General Application Process: <br /> <br />1. The Applicant/Operator Name is listed as “Bad Boys of Cripple Creek Mining Co., LLC”. Upon review of the <br />Colorado Secretary of State’s registered businesses, your business is “BAD BOYS OF CRIPPLE CREEK <br />MINING CO., INC.”. Please clarify LLC vs. INC. discrepancy and update the application or the registration <br />with the Colorado Secretary of State as appropriate. <br /> <br />2. The details provided for the Location Information (Question 10, Page 3) and Primary Mine Entrance Location <br />(Question 11, Page 3) were incomplete. Please check the direction box for the Township and Range (this should <br />be Township 15S and Range 70W) and both Latitude and Longitude coordinates are provided for the mine <br />entrance (38°45'14.02"N 105°10'36.88"W). <br /> <br />3. Responsibilities #7 and #8 were not initialed on Page 5 of the application. Please resubmit a new Page 5 with all <br />responsibilities initialed. <br /> <br />4. Although not a filing requirement, pursuant to Rule 6.2.1(2)(d), the Division requests a table of the <br />latitude/longitude coordinates for each of the proposed permit boundary corners. This information will be <br />utilized in the review of the permit application once it is found complete for filing, assist the Division in <br />conducting future inspections of the operation, and provide a more thorough permit file. <br /> <br />EXHIBIT A – Legal Description and Location (Rule 6.3.1): <br /> <br />5. The application did not contain an Exhibit A. Please provide an Exhibit A which includes: <br />• A legal description which identifies the affected lands as required by Rule 6.3.1(1); <br />• A USGS Topo Map with the main entrance identified and listed with the latitude/longitude coordinates as <br />require by Rule 6.3.1(2); and <br />• Either an additional map or the USGS Topo Map required above, identifying the following as required by <br />Rule 6.3.1(3): <br />o the affected lands,
