BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF REQUEST FOR EXTENSION FOR CONSIDERATION OF <br /> THE PERMIT AMENDMENT APPLICATION OF COULSON EXCAVATING <br /> COMPANY, INC., File No. M-1986-123 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> June 18, 2025, as a consent agenda item for a request for an extension of the deadline <br /> for consideration of the permit amendment filed by Coulson Excavating Company, <br /> Inc. ("Applicant"), file number M-1986-123. <br /> The Board, having considered the materials presented with this consent <br /> agenda item and being otherwise fully informed of the facts in the matter, enters <br /> the following: <br /> FINDINGS OF FACT <br /> 1. Applicant has a 112(c) permit for a sand and gravel operation located <br /> in Section 15, Township 5 North, Range 68 West, 6th P.M., for a site known as the <br /> Kirtright Pit. <br /> 2. Applicant filed a permit amendment application on June 14, 2024 <br /> CAMP)). <br /> 3. The 365-day review period expired on June 14, 2025. <br /> 4. Applicant has requested an extension beyond the June 14, 2025 <br /> deadline to August 10, 2025 to allow it to provide the Division with hydrologic <br /> modeling of a portion of the affected lands to address items raised in the Division's <br /> adequacy review letters. <br /> 5. The Division does not oppose Operator's request for an extension. <br /> CONCLUSIONS OF LAW <br /> 6. The Board has jurisdiction over this matter pursuant to the Colorado <br /> Land Reclamation Act for the Extraction of Construction Materials, Article 32.5 of <br /> Title 34, C.R.S. (2024). <br />
