reclamation plans include avoidance, restoration, and monitoring measures of the above <br /> mentioned species to preclude destruction of habitat for these species. Wildlife monitoring <br /> was discontinued when mining operations ceased and at the writing of this document, <br /> the reclamation operations are complete. The wildlife inventory in the currently approved <br /> permit application package, has been updated periodically over the life of mine and remains <br /> valid as it was recently verified against the state species databases and adequately <br /> addresses the current list of threatened and endangered species known to occur in Routt <br /> County, Colorado. <br /> Seneca Property, LLC originally estimated that the Yoast mining operation might result in <br /> an annual depletion of as much as 53.7 acre-feet of surface water from the Colorado River <br /> basin. The USFWS determined that this depletion could affect the future occurrence of the <br /> Ptychocheilus Lucius (Colorado squawfish)Xyrauchen texanus (razorback sucker), Stipa <br /> tenuissiam (bonytail chub), and Gila cypha (humpback chub). These four species of fish <br /> are federally listed as endangered species. However, an ongoing habitat recovery project <br /> conducted by USFWS serves to mitigate impacts due to water depletion from the river <br /> basin. <br /> No threatened or endangered plant species were identified in the permit area. On the basis <br /> of information submitted by Seneca Property, LLC, the U.S. Fish and Wildlife Service, and <br /> Colorado Parks and Wildlife, the Division finds that the activities proposed by the applicant <br /> would not affect the continued existence of endangered or threatened species or result in <br /> the destruction or adverse modification of their critical habitats (2.07.6(2)(n)). <br /> 16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As <br /> of this time, Seneca Property, LLC, the operator is current in the payment of reclamation <br /> fees required by 30 CFR Chapter VII, subchapter R (2.07.6(2)(o)). <br /> 17. Specific approvals have been granted or are proposed. These approvals are addressed in <br /> the following section, Section B (2.07.6(2)(m)). <br /> Section B <br /> The following findings and specific approvals are required by Rule 4. Rules pertinent to the Yoast <br /> mine site,a surface mining site are treated below. <br /> I Roads Rule 4.03 <br /> All roads within the permit boundary are depicted on Exhibit 12-1, "Operations Plan". <br /> Information regarding road construction is located in Tab 13 of the permit application. <br /> The Division approved the retention of access and light use roads as they are compatible <br /> with the approved post-mining land use. The haul roads were reduced to a width of twenty <br /> feet and associated disturbance was reclaimed(4.03.1(1)(f)(0). <br /> II Support Facilities - Rule 4.04 <br /> Support facilities used in conjunction with the Yoast Mine included a coal stockpile area, <br /> shop, warehouse, bath house, explosives storage magazines and bins, power lines and a <br /> substation, and fuel storage tanks. All facilities were constructed to prevent damage or <br /> disruption of utility lines, water wells, railroads, and pipelines which may pass over, <br /> through, or under the permit area. All support facility structures have been demolished <br /> with the exception of the power lines and substation, which have been remained as <br /> 10 <br />
