17.4.Tenant Obligations upon Termination: Upon termination of this Lease with respect to all <br /> or any part of the Leased Premises, Tenant agrees to furnish Landlord with a document <br /> reasonably satisfactory to Landlord verifying such termination and release of Lease. If• <br /> this Lease,terminates without Tenant having successfully obtained Permits satisfactory to <br /> allow it to commence operations, Tenant shall provide Owner with all documents and <br /> materials submitted in connection with the Permits or referenced therein.Any documents <br /> and materials so supplied shall be supplied "as-is, with all faults" and without any <br /> warranty whatsoever, including without any warranty of merchantability or fitness for a <br /> particular purpose, and Tenant expressly disclaims and shall have no liability to Owner <br /> for any third party.in connection with Owner's use of any such documents or materials. <br /> 1 7.5.Tenant Right to Recover Funds upon Termination: Upon termination of this Lease by <br /> Tenant for any reason, all sums paid hereunder to Landlord shall remain the Leased <br /> Premises of Landlord and shall not be recoupable or refundable except to the extent that <br /> they have already been recouped or refunded as of the effective date of termination. <br /> 17.6.Tenant Right to Cure: Tenant may cure any default of Landlord by expending funds or <br /> by any other actions. If Tenant takes any such actions, Landlord will promptly, upon <br /> demand, reimburse Tenant for all of Tenant's expenses. In the event the default involves <br /> the payment of a monetary obligation to a third party, Tenant shall have the right to pay <br /> said amounts with notice of payment to Landlord and subsequently deduct the same <br /> from the next Royalty Payment due Landlord under this Lease agreement. <br /> 18. End of Term <br /> 18.1.Tenant shall have the right for 9 months from the date of expiration or termination of <br /> this Lease to dismantle and remove machinery, equipment, improvements, and other <br /> facilities installed or constructed on the Leased Premises by Tenant and also to sell and <br /> remove Materials then stockpiled on the Leased Premises, subject to its obligation to pay <br /> Sales Royalties pursuant to Paragraph 5.2. Tenant shall not mine any additional Material <br /> following expiration of termination of this Lease. ' <br /> 19.No Development Covenant: There is no implied covenant or obligation of to explore, <br /> develop,or mine the Leased Premises or to sell Materials. Tenant may maintain this Lease in <br /> effect for up to 1 year by making the payments set forth under section 5 Lease automatically <br /> terminates if not mined for more than 1 year, unless approved in writing by Landlord. <br /> 20. Tenant Obligation regarding Restoration of Leased Premises <br />
