site and mining conditions and market and other economic conditions. To the extent <br /> shown on Exhibit C, Tenant shall have the right to construct, maintain, and use roads, <br /> pipe lines, power lines, telephone lines, and stockpile areas it deems necessary or <br /> desirable for its operations on the Leased Premises related to Tenant's operations under <br /> this Lease. • When deemed necessary or to continue operations, Tenant will be <br /> responsible for relocating existing utilities. • <br /> • <br /> 8.3. Tenant Authority Regarding Applications and Permits: Landlord hereby authorizes <br /> ' Tenant, at Tenant's expense and in Tenant's name, if required, to apply for zoning <br /> classifications, variances or exceptions, and governmental approvals, Permits, licenses <br /> for rights related to and required for Tenant's operations hereunder. Landlord agrees to <br /> cooperate with Tenant in obtaining such approvals and to execute or join in applications, <br /> and other documents which are required in connection with the operations and are <br /> contemplated under this Lease; provided, however, Tenant shall provide bonds or other <br /> financial assurance for its operations, including for the restoration, reclamation, or <br /> rehabilitation of the Leased Premises, as may be required to obtain such Permits and <br /> approvals. Any special use permit application and approval with Eagle County shall <br /> attach to and run with the land unless Landlord provides written consent to another <br /> arrangement. Any application to State agencies shall include the option for Landlord to <br /> 'cause the permit or approval to be assigned to Landlord at Landlord's election upon <br /> termination of this Lease. <br /> 8.4. Tenant Rights to Subcontract Work: Tenant shall have the right to subcontract with <br /> others for the performance of exploration, development, asphaltic and concrete <br /> production and mining work hereunder subject to all terms of the Lease, but no such <br /> subcontract shall relieve Tenant of its obligations to Landlord hereunder. <br /> 8.5. Tenant Right to Construct. Maintain, and Sublet Plants: Tenant shall have the right to <br /> construct, maintain, and sublet Plants on the Leased Premises at locations selected by <br /> Tenant,and Landlord agrees that Tenant shall have full right access for the construction, <br /> use and maintenance of the Plants and for stockpiling Materials processed or to he <br /> processed. <br /> 8.6. Additional Utility Easements: Landlord agrees to provide any new utility easements <br /> necessary to facilitate Tenant's operations on the Leased Premises.Tenant will work with <br /> Landlord to find best location for any new easements. <br /> 9.
