Cunningham, Director June 23, 2025 Marcelo Calle Office of Surface Mining Western Region One Federal Center, Building 41 PO Box 25065 Denver, CO 80225 Re: West Elk Mine (Permit No. C-1980-007) Technical Revision Application No. 157 (TR-157) TR-157 Sylvester Gulch Drainage Modifications Dear Sir or Madam: The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 118, Paragraph 3, of the Colorado Revised Statutes, that on June 23, 2025, an application to revise coal mining operations at the West Elk Mine was considered complete for the purposes of filing. All review and comment periods as provided in the Act and the Regulations initiate from this date of filing. With Technical Revision no. 157 (TR-157), Mountain Coal Company seeks to permit a construction project that will redesign the stormwater drainage system in Sylvester Gulch to redirect stormwater from undisturbed land and to capture the stormwater from small disturbances that have previously been permitted as Small Area Exemptions (SAEs), and route it to sediment ponds. The applicant is not proposing additional surface disturbance outside of the area currently approved for disturbance. The underground coal mining operation is on land located approximately 9 miles East of Paonia, Colorado. The permit area is further described as follows: All or portions of Sections 9 through 36 (inclusive), Township 13 South, Range 90 West; Sections 23 through 26 (inclusive), Township 13 South, Range 91 West; Sections 1, 2, 3, 4, 5, 8, 9, 10, 11, 12, 14, 15, 16, 21, 22 and 23, Township 14 South, Range 90 West; all of the 6th Principal Meridian. The above-mentioned tracts of land are shown on the following USGS 7.5 minute Quadrangle map(s): Somerset.
