BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> Violation No. PV-2024-002 <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF THE FORFEITURE OF THE FINANCIAL WARRANTY OF <br /> THE MINING COMPANY, INC., FILE NO. P-2007-058 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") <br /> on February 19, 2025, for a hearing to consider the forfeiture of the financial <br /> warranty of The Mining Company, Inc. ("Prospector"), file number P-2007-058. <br /> Lucas West appeared on behalf of the Division of Reclamation, Mining and Safety <br /> ("Division"). There was no appearance on behalf of the Prospector. <br /> The Board, having considered the parties' presentations and materials <br /> submitted and having been otherwise fully informed of the facts in the matter, <br /> hereby enters the following: <br /> FINDINGS OF FACT <br /> 1. The Prospector holds a Notice of Intent ("NOI") for a 2.19-acre gold and <br /> silver prospecting operation. The site, known as the Liberty Project, is located in <br /> Section 20, Township 43 North, Range 8 West, 10th Principal Meridian in Ouray <br /> County, Colorado. <br /> 2. The Division holds a financial warranty for the NOI in a cash bond in <br /> the amount of$7,600.00 and a certificate of deposit in the amount of$10,362.00. <br /> 3. Following a hearing on October 16, 2024, the Board issued an order, <br /> effective on November 18, 2024, (the "November 2024 Order") finding Prospector in <br /> violation section 34-32-116(3), C.R.S. and Rule 5.6 for failure to submit the required <br /> annual fees, map, and report. <br /> 4. The November 2024 Order also revoked the NOI and found that the <br /> financial warranty for the NOI was subject to forfeiture. <br /> 5. On January 13, 2025, the Division mailed Prospector notice that the <br /> financial warranty was subject to forfeiture and that a hearing would be held at the <br /> Board's February 19, 2025 meeting to consider final forfeiture. <br /> 6. Prospector did not appear at the February 19, 2025 hearing. <br />
