King Coal Mine (C-1981-035) MT-9 <br /> • Minor Revision No.52 was received by the Division on September 13, 2023. The Revision was <br /> approved and issued on October 4, 2023. MR-52 updated the PAP with a new KI Map 007 to <br /> combine the approved lower refuse final design from Technical Revision No. 27 and the activities <br /> approved under Technical Revision No. 30. <br /> • Minor Revision No. 53 was received by the Division on November 5, 2024. The revision was <br /> withdrawn on November 22, 2024. <br /> Section III - Status of Stipulations <br /> The stipulation history for the King Coal Mine was reviewed as part of the midterm review. Permit No. <br /> C-1981-035 has no active stipulations. <br /> Section IV— Permit Variances and Specific Approvals <br /> There are no variances for the King Coal Mine for the following practices: experimental practices, <br /> mountaintop removal, or practices related to combined surface/subsurface mining. <br /> The King Coal Mine does not fall within the Steep Slope Mining category of 2. 06. 5 and 4. 27, so no <br /> variance to approximate original contour was requested or required. However, the King I Mine <br /> highwall was in place prior to August 3, 1977, making applicable the provisions of 4.14.1(2)(f). This <br /> rule provides GCC some leeway in terms of the elimination of this highwall. That said, the GCC <br /> reclamation plan in the PAP includes reducing all mine bench highwalls and the bench outslope crest <br /> to approximately 1.5 h:1v and in most areas to 2.5h :1v, or less, to blend in with surrounding areas. <br /> Section V - Enforcement Actions <br /> Since approval of RN-08 (November 21, 2022), no violations have been issued for the King Coal Mine. <br /> All violations issued before that date have been resolved. <br /> Section VI - Identified Issues and Required Revisions <br /> The following issues need to be addressed by GCC. Items that are in bold type should be addressed <br /> with revisions to the permit. <br /> 1. GCC needs to work with the Division to establish groundwater points of compliance (POCs) <br /> downgradient of the King Coal Mine. As necessary, update the PAP to include a discussion of <br /> POCs. The Division recommends that this revision be incorporated within Section 2.05.6, on <br /> the first page as well as within the Water Monitoring section. <br /> 2.
