BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> Notice of Violation No. MV-2025-004 <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF A POSSIBLE VIOLATION BY COLORADO QUARRY I, <br /> LLC, CORRECTIVE ACTION, CEASE AND DESIST ORDER, AND CIVIL <br /> PENALTIES FOR FAILURE TO PROTECT AREAS OUTSIDE OF THE <br /> AFFECTED LAND FROM SLIDES OR DAMAGES OCCURRING DURING THE <br /> MINING OPERATION, File No. M-2009-006 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") <br /> on March 19, 2025, to consider possible violations by Colorado Quarry I, LLC <br /> ("Operator"), cease and desist order, corrective action, and civil penalties for <br /> failure to protect areas outside of the affected land from slides or damages <br /> occurring during the mining operation, file number M-2009-006. Jocelyn Carter <br /> and Amy Eschberger appeared on behalf of the Division of Reclamation, Mining, <br /> and Safety ("Division"). Bryce Bohl, Bret Ludwick, and Jay Panzarella appeared <br /> on behalf of Operator. <br /> The Board, having considered the presentations, testimony, materials <br /> submitted, and being fully informed of the facts in the matter, enters the following: <br /> FINDINGS OF FACT <br /> 1. The Operator holds a 110(c) permit for a 9.9-acre sandstone operation <br /> located in Section 27, Township 4 North, Range 70 West, 6th Principal Meridian in <br /> Larimer County, Colorado, permit number M-2009-006. The site is known as the <br /> Meadow Hollow Quarry. <br /> 2. On December 27, 2024, the Division conducted an inspection of the <br /> site. During the inspection, the Division observed that approximately 1.79 acres of <br /> land had been affected outside the permit boundaries. This area included storage of <br /> product material, palletized product material, material handling equipment, <br /> material processing equipment, a shed used for storing chemicals and hand tools, a <br /> truck scale, and a scale house. The inspection report, signed February 3, 2025, <br /> noted the offsite impacts as a potential violation of failure to protect areas outside of <br /> the affected land from slides or damage occurring during the mining operation. <br /> 3. On February 4, 2025, the Division mailed the Operator a Reason to <br /> Believe a Violation Exists Letter, informing the Operator of the possible violation <br />
