Paul Banks and Associates, LLC Exhibit M-Other Permits and Licenses County Land Use Permit Special Use Permit No. 2004-004 was approved and issued by Pueblo County on March 23,2004. Special Use Permit No 2004-004 Second Amendment was approved and issued on January 20, 2023 County Flood Hazard Area Development Permit A Pueblo County Flood Hazard Area Development Permit was approved on May 10. 2004 COPS State Discharge Permit/Stormwater Permit Colorado Discharge Permit No. COG-500000 for Facility Number COG-500453 was issued on June 23.2008 and will expire on June 30 2013. In addition, the applicant has created and executed a Stormwater Management Plan in accordance wth the discharge permit. Modification 1 issued: 12/29/2022 Effective : 12/01/2022 Certification issued: 12/22/2016 Effective : 01/01/2017 Expiration Date: 12-31-2026 The general permit COG500000 expired 12/31/2017 and is administratively continued. The certification is also administratively continued. It will remain in effect until the general permit is renewed, or other actions are taken. Air Permits Final Approval of Air Permit No 04PB0262F was granted on April 18 2006, by the Colorado Department of Public Health and Environment-Air Pollution Control Division. Then following activities are subject to the air permit limitations:aggregate extraction, handling. stockpiling and hauling.This permit was renewed on November 16, 2009 and the next renewal will be due on October 16 2014. Issuance No. 3 of Permit No: 04PBO262F was issued 11/01/2018 and the timely renewal of this permit was submitted on June 14, 2023. The next air permit renewal date is 05/16/2028. Road Access and Maintenance Agreements On September 13,2005,the Pueblo Board of County Commissioners accepted the required road improvements to Nyberg Road as part of the Pueblo County Highway System and for maintenance purposes via Resolution No.05-233. On October 14, 2005, the applicant received an approval letter from Todd Ausbun, COOT Region II Access Inspector. Specifically,the access improvements onthe south side of State Highway 50B at, approximately, milepost 327.40at Nyberg Roadwas inspected and deemed sufficiently install in accordance with the terms and conditions listed in Access Permit No. 204038. Gravel Pit Well Permit/Substitute Water Supply Plan/Replacement Water Lease Gravel Pt Well Permit No. 62251-F was issued on February 14,2005 for aggregate production and dust suppression. Specifically,this permit allows an annual groundwater appropriation of 44.67 acre-feet and a pond with a total surface area of 9.76 acres.The use of groundwater, in addition to evaporation, is limited to dust suppression and water lost in product. This well is operated in accordance with the St. Barbara Sand and Gravel Pit Substitute Water Supply Plan approved by the State Engineer on December 3,2004 and subsequently renewed on May 20, 201 1(effective January 1,2011-December 31, 2012.The source of replacement water for the Plan is via a 10-year lease with the Pueblo Board of Water Works, which was initially executed on April 13, 2004 and subsequently renewed on November 5, 2010.
