SUNROC <br /> Andrew Azcarraga <br /> 15381 58 1/2 Road <br /> Collbran, CO 81624 <br /> March 6, 2025 <br /> Re: Cole Gravel Pit (aka Kannah Creek Pit) — DRMS File No. M-2004-020— <br /> Succession of Operator— Structure Agreement for Compensation for Damage to <br /> Structures Within 200 Feet of Mining Activities <br /> To Whom it May Concern: <br /> Sunroc Corporation (Sunroc) is the new operator for the Cole Gravel Pit (aka Kannah <br /> Creek Pit) 112 Construction Materials Permit located 5.5 miles southeast of Whitewater, <br /> 1.5 miles east of US Highway 50 and approximately 0.5 miles south of Kannah Creek <br /> Road. The site is in Section 3, Township 3 South, Range 2 East of the Ute Meridian. The <br /> pit was previously operated by M.A. Concrete Construction, Inc. <br /> One of the requirements for the succession of operator is to send out new structure <br /> agreements for structure owners that are within 200 feet of the mining permit boundary. <br /> The Colorado Mined Land Reclamation Act provides protection for your property, and <br /> specific protection for your structures located within 200 feet of the mining activities. Your <br /> property is adjacent to the mine property and within 200 feet of the mining activities. <br /> DRMS approval requires a notarized agreement between the applicant and owners of <br /> structures within 200 feet of the mining activities, providing compensation for any damage <br /> to the structure; or preparation of an engineering evaluation acceptable to the DRMS, <br /> demonstrating that such structure(s) shall not be damaged by the mining activities if an <br /> agreement cannot be reached. <br /> Sunroc has had an engineering evaluation performed to confirm that the current setbacks <br /> from their mining permit boundary and mining limit to structures adjacent to the mining <br /> are acceptable. The proposed mining slopes and setbacks will be analyzed using the <br /> Galena v7.2 computer program. Galena was designed to analyze the slope stability of <br /> earth embankments subjected to several critical situations that may occur during the life <br /> of the embankment. The procedure searches for circular shear failures and automatically <br /> searches for the lowest safety factor. 20,000 separate failure surfaces will be analyzed <br /> for each case. The required minimum safety factors are based on the current standards <br /> used by the DRMS. The safety factors attained using the setbacks shown on the Mining <br /> Plan are will be greater than the required safety factors specified by the DRMS for an <br /> 2323 River Road,Grand Junction,CO 81505 <br />
