Lessor and Lessee entered into that certain Gravel Pit Lease Agreement dated <br /> November 8, 2024 ("Lease") for certain real property located in Mesa County, State of <br /> Colorado ("Property"), more particularly described on Exhibit A, attached hereto and <br /> incorporated herein by reference. <br /> 2. The Lease has an initial term of five (5) years, with one (1) five (5) year lease <br /> renewal term. <br /> 3. The Commencement Date of the Lease is November 8,2024. <br /> 4. The expiration of the initial term of the Lease is November 7, 2029. <br /> 5. The Lease shall survive sale of the Property by Lessor or any successor of <br /> Lessor to a third party, not the Lessee. <br /> 6. The purpose of this Memorandum is to give record notice of the Lease. This <br /> Memorandum is not a complete description of the terms and conditions of the Lease, and <br /> shall not be used in interpreting the terms and conditions of the Lease. In the event of a <br /> conflict between the terms of this Memorandum and the Lease, the Lease shall control. The <br /> terms of the Lease are hereby incorporated by reference.
