EXHIBIT D <br /> MINING PLAN AND TIMETABLE <br /> AMENDMENT 02 <br /> This amendment will cover five (5) changes: first, the <br /> boundary of the mine will be amended to more accurately reflect <br /> the boundary of the current clay and sandstone mining; second, <br /> the final reclamation plan will be changed to include the <br /> preferred end use option of developed water storage surrounded by <br /> rangeland; the third is to allow mining and processing of the <br /> sandstone and other miscellaneous rock products along the east <br /> and west sides of the clay deposit; the fourth is to include a <br /> composting operation; and the last is to finalize completion of <br /> the ditch relocation anticipated in the 1984 Amendment . The <br /> first, third, fourth, and fifth items are directly addressed in <br /> this mining plan. <br /> The methods described and approved in the original mining <br /> plan as well as the 1984 Amendment will remain unchanged unless <br /> discussed in this text . The following text is a combination of <br /> the 1979 original permit and 1984 amendment exhibits edited to <br /> cover current conditions from this time forward. The plan has <br /> been revised to reflect the proposed changes, current methods of <br /> operation, and practices that have changed since the original <br /> permit application in 1979 and the first amendment in 1984 . <br /> The amendment will follow MLRB Rule 1 . 8 and Colorado Revised <br /> Statutes, 1992, Section 34-32-112 (8) . <br /> MINING PLAN <br /> Location <br /> The Lakewood Brick and Tile Co. operates the Church Pit (M- <br /> 1979-045) , which is located at 20777 West Gate Road, Golden, <br /> Colorado. It is approximately one-quarter mile east of Highway 93 <br /> and adjacent to the Rocky Flats National Wildlife Refuge in <br /> Jefferson County. Access is from the intersection of HWY 93 and <br /> Westgate Road, approximately 10 miles north of Golden, Colorado. <br /> From the intersection of HWY 93 and Westgate Road, travel <br /> approximately one-quarter mile east on Westgate Road, then <br /> approximately 1350 feet northeast along an existing access road <br /> to the entrance. <br /> The Church Pit and the adjacent Rocky Flats Pit (M-1987- <br /> 113) , which is operated by BURNCO Colorado, are located on land <br /> owned by the US Department of Energy with mineral rights owned by <br /> Church Ranch (Charles and Perry McKay) . Upon completion of final <br /> reclamation, the permit area will become part of the Rocky Flats <br /> National Wildlife Refuge.
