On June 12, 2024, the Division conducted an inspection of the New Elk <br /> Mine and issued notice of violation CV-2024-002 on June 20, 2024 for failure to <br /> maintain certification that Operator has a public liability insurance policy in full <br /> force and effect for the life of the mine. <br /> 6. On August 28, 2024, the Division extended the resolution deadline by <br /> 90 days for violation CV-2024-001, Lorencito Canyon Mine. On the following day, <br /> the Division issued a Failure to Abate Violation Cessation Order (CO-2024-001) for <br /> CV-2024-001. <br /> 7. On September 18, 2024, the Division extended the resolution deadline <br /> by 90 days for violation CV-2024-002, New Elk Mine. On the following day, the <br /> Division issued a Failure to Abate Violation Cessation Order (CO-2024-002) for CV <br /> 2024-002. <br /> 8. On September 30, 2024, the Division Director issued an Order to Show <br /> Cause, requiring the Operator to respond and explain why the permits for the <br /> Lorencito Canyon and New Elk mines should not be revoked. The Operator did not <br /> respond to the order. <br /> 9. On October 25, 2024, the Division published the Show Cause Public <br /> Notice for both mines in the Trinidad Chronical-News. <br /> 10. On January 29, 2025, the Division provided notice to the Operator that <br /> a public hearing on the Lorencito Canyon and New Elk mines permit revocation <br /> would be held at the Board's March 19, 2025 meeting. Notice of the hearing was <br /> published in the Trinidad Chronical-News on February 21, 2025. <br /> 11. At the hearing, the Division presented testimony regarding the mines, <br /> the state of each site, its efforts to contact representatives from the Operator, and <br /> the Division's engagement with parties interested in acquiring the permits. In <br /> particular, the Hill Family, which owns the land on which the Lorencito Canyon <br /> Mine is located, plans on acquiring the permits and remedying the violations for <br /> each permit. The Division asked the Board to suspend the permits, which gives the <br /> Division the option of seeking revocation and bond forfeiture should that become <br /> necessary. <br /> 12. Representatives for the Hill family also presented testimony regarding <br /> the sites and their efforts to acquire the permits. The Hill Family owns the mineral <br /> rights to the Lorencito Canyon Mine, which has coal that can be exported for <br /> New Elk Coal Company, LLC. <br /> New Elk Mine, Permit No. C-1981-012 <br /> Lorencito Canyon Mine, Permit No. C-1996-084 2 <br />
