In response,we have implemented revisions addressing <br /> two distinct issues: <br /> 1. Proof of Publication for Public Notices <br /> Pursuant to Rule 1.6.2(1)(e) of the Colorado Mining Rules and Regulations, we have fulfilled our obligation <br /> to publish the required public notice. Please be advised that proof of publication has been mailed to both the <br /> Colorado State Land Board and the Bureau of Land Management. The notice was published in the Craig Press on <br /> December 25, 2024, with additional publications on January 1, January 8, and January 15, 2025. Enclosed, please <br /> find copies of the mailing receipts and related documentation verifying these actions. <br /> 2. Revised Acreage Delineation (Exhibit D) <br /> In response to your comments regarding the delineation between `affected' and`disturbed' acreage, we have up- <br /> dated our narrative as follows: <br /> • Under the current 110 permit, approximately 9.9 acres are already disturbed. <br /> • With the new 112 permit, we propose to disturb a maximum of four 5-acre mining blocks (totaling 20 acres) •" <br /> in addition to the existing disturbed area and the 6-acre footprint for the screening plant. <br /> This revision increases the maximum total disturbed acreage to 29.9 acres at any given time. The updated nar- <br /> rative clarifies that mining activities will occur in sequential phases—ensuring that one block is actively mined, <br /> one is in the stripping phase, and one is under reclamation—so that the disturbed acreage does not exceed the <br /> revised limit. <br /> We trust that these revisions address your concerns regarding both the proof of publication and the accurate <br /> delineation of disturbed acreage.
