BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW,AND ORDER <br /> IN THE MATTER OF THE PERMIT APPLICATION FOR 112C OF CENTRAL <br /> COLORADO WATER CONSERVANCY DISTRICT; File No. M-2024-015 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> December 11, 2024 for a hearing to consider the application of Central Colorado <br /> Water Conservancy District ("Applicant") for a 112c Permit, file number M-2024- <br /> 015. <br /> Brock Bowles appeared on behalf of the Division of Reclamation, Mining and <br /> Safety ("Division"). J.C. York, P.E., a consultant with J&T Consulting, Inc., <br /> appeared on behalf of Applicant. <br /> The Board, having considered presentations, testimony, materials submitted, <br /> and being otherwise fully informed of the facts in the matter, enters the following: <br /> FINDINGS OF FACT <br /> 1. Applicant filed an application with the Division for a 112c reclamation <br /> permit for a sand and gravel site known as the Sweet Valley Pit in Weld County, <br /> Colorado ("Application"). The proposed site includes 150.92 acres in Section 30, <br /> Township 4 North, Range 66 West, 6th Principal Meridian. <br /> 2. The Application proposes phased mining with multiple cells mined <br /> with post-mining use of developed water resource by creating two reservoirs. <br /> 3. During the public comment period, as mandated by Rule 1.7.1 of the <br /> Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board for <br /> the Extraction of Construction Materials, 2 CCR 407-4 ("Rules"), the Applicant <br /> published notice in the Greeley Tribune once a week for four consecutive weeks and <br /> mailed required notices in accordance with the Rules. During the public comment <br /> period, which closed on June 6, 2024, the Division received four timely letters of <br /> objection and two agency comment letters from the Division of Water Resources and <br /> Colorado Parks and Wildlife. <br /> 4. On November 6, 2024, based on the applicable requirements of the <br /> Colorado Land Reclamation Act for the Extraction of Construction Materials, <br /> Article 32.5 of Title 34, C.R.S. ("Act") and the Rules, the Division issued and served <br /> all parties both a written recommendation for approval of the Permit Application <br /> over objections and a written rationale for that recommendation. <br />
