// PAGE 1 <br />EXHIBIT S <br /> <br />Raptor Materials, LLC Cogburn, Gravel and Reservoir Project February 2025 <br />A Regular Impact (112) Construction Permit Application – Colorado Division of Reclamation Mining and Safety, Office of Mined Land Reclamation <br />Exhibit S – Permanent Man-Made Structures <br /> <br />Where the affected lands are within two hundred (200) feet of any significant, valuable and permanent man- <br />made structure, the applicant shall: <br />SECTION 1 <br />provide a notarized agreement between the applicant and the person(s) having an interest in the structure, <br />that the applicant is to provide compensation for any damage to the structure; or <br />The notarized agreements between the applicant and the person(s) having an interest in the structure, that <br />the applicant is to provide compensation for any damage to the structure are attached as an addendum to <br />this Exhibit S. Notarized agreements obtained are with: <br />- Accord St Vrain Valley Ranch, LLC <br />- Robert Allen Collins <br /> - Town of Firestone <br />- LG Everist Inc <br />- Platteville Dairy, LLC <br />- Ready Mixed Concrete Company <br /> <br />A complete list of structure owners is shown on Exhibit C-1: Existing Conditions Map and are attached as an <br />addendum to this Exhibit S. <br />SECTION 2 <br />where such an agreement cannot be reached, the applicant shall provide an appropriate engineering <br />evaluation that demonstrates that such structure shall not be damaged by activities occurring at the <br />mining operation; or <br />A slope stability analysis performed by American Water Engineering Services, LLC is included as an <br />addendum to this Exhibit S. <br />SECTION 3 <br />where such structure is a utility, the Applicant may supply a notarized letter, on utility letterhead, from the <br />owner(s) of the utility that the mining and reclamation activities, as proposed, will have "no negative effect" <br />on their utility. <br />The notarized agreements between the applicant and the person(s) having an interest in the utility, that the <br />applicant is to provide compensation for any damage to the utility are attached as an addendum to this <br />Exhibit S. Notarized agreements obtained are with: <br />- Panhandle Eastern Pipeline Company <br />- Resource Gathering System, Inc. <br />- Snyder Oil Corporation <br />- HS Resources, Inc. <br />- Kerr-McGee Gathering, LLC <br />- Kerr-McGee Rocky Mountain Corporation <br />- Weld County Department of Public Works <br />- City of Thornton <br />- Noble Energy <br />- Last Chance Ditch Company
