<br />March 13, 2025 <br />Mr. Patrick Steele <br />PB& S Sand and Gravel LLC <br />8425 Park Road <br />Rye, CO 81069 <br />Re:Ghost River Gravel Pit, FileNo.M-2024-029 <br />Financial and/or Performance Warranty Required <br />Dear Mr.Steele: <br />The Mined Land Reclamation Board (Board) has directed the Divisionof Reclamation, Mining <br />and Safety (Division)to remind applicants when they have not posted the required financial <br />warranty and/or the performance warranty within nine months ofthe application approval date. <br />Pursuant to the Act, no permit may be issueduntil the Board or Office receives and approves <br />the performance and financial warranties. <br />As of the date of this notice, our records indicate that you have not posted the required <br />Financial Warranty and Performance Warrantyfor your approved Mined Land <br />ReclamationBoard application, File No. M-2024-029.In accordance with Rule 4.1(2) of <br />the Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board for <br />the Extraction of Construction Materials,no permit may be issued until the Board or <br />Office receives and approves the Performance and Financial Warranties required herein. <br />If these warranties are not postedby December 2, 2025(365 days from the date your <br />application was approved),you willbe scheduled for a Formal Board Hearing, in <br />accordance with the notification and comment provisions of Rule 1.6, to reconsider the <br />previous application approval. If the Board affirms the original application approval, <br />the Board shall establish a new deadline for submittal of the warranties.
