Exhibit 1 <br /> applicable groundwater standards or permit conditions imposed to protect <br /> groundwater quality. <br /> 15. Notwithstanding the above, CC&V does not admit to any of the factual or legal <br /> determinations made by the Division herein, however any action undertaken by CC&V pursuant <br /> to this Stipulated Agreement shall not constitute evidence of fault or liability by CC&V with <br /> respect to the conditions of the Cresson Project. CC&V expressly reserves its rights to deny any <br /> of the Division's factual or legal determinations or defend itself in any other third party <br /> proceeding not adjudicated by the Mined Land Reclamation Board in this proceeding relating to <br /> the information identified in this Stipulated Agreement. <br /> 16. A Cease-and-Desist Order shall issue prohibiting any further addition of <br /> overburden materials to the ECOSA beginning on January 1, 2025 until CC&V completes the <br /> corrective actions set forth in 17 a. Short Term Corrective Action. However, if the Cease-and- <br /> Desist Order is not lifted through completion of the pump-back system set forth in Paragraph 17 <br /> a. by October 1,2025, then the Division and CC&V will meet to discuss the status of the project. <br /> If at that point DRMS finds that CC&V has made a good faith effort to install the pump back <br /> system required by Paragraph 17 a. (that is, CC&V provides evidence that (a) CC&V timely <br /> submitted all necessary TR application materials and (b) delay in construction is due to supply <br /> chain delays or other delays outside of CC&V's control),then DRMS will lift the cease and desist <br /> order by December 31, 2025, at the latest. DRMS reserves the authority to re-institute the Cease- <br /> and-Desist Order if CC&V fails to pursue,in good faith,completion and certification of the pump- <br /> back system. <br /> 17. CC&V has undertaken activities to minimize further migration of contaminated <br /> water and to protect ground and surface water systems, including the actions described above. <br /> Consistent with those activities,CC&V agrees to complete the following corrective actions: <br /> a. Short Term Corrective Action: Submit a Technical Revision (TR) for a temporary <br /> pump-back system to capture groundwater contamination from the ECOSA. As a <br /> part of the TR, CC&V shall propose a plan to accurately define the full extent of <br /> the contamination plume by implementing drilling and/or geophysical methods, <br /> include a plan for performance monitoring that will inform the need for installing <br /> up to two additional monitoring wells through a separate TR as set forth in <br /> Paragraph 17 b., and address how temporary augmentation will be addressed to <br /> protect downstream water rights for the water removed by the system.The TR shall <br /> be reviewed in accordance with the following schedule: <br /> Milestone Description <br /> Before TR submittal CC&V and the Division will <br /> cooperate in advance of filing the TR <br /> to discuss the design and address high- <br /> level concerns <br /> 4 <br />
