ASPINALL STORAGE UNIT <br /> LONG-TERM WATER SERVICE CONTRACT BETWEEN <br /> THE UNITED STATES <br /> AND <br /> OLDCASTLE SOUTHWEST GROUP, INC. <br /> THIS CONTRACT is made this day of rvi. 2020, under <br /> the authority of the Reclamation Act(Ac of June 17, 190Ach, 093,732 Stat. 388), and acts <br /> amendatory thereof and supplementary thereto, and particularly the Colorado River Storage <br /> Project Act of April 11, 1956 (43 U.S.C. §§ 620, et seq.), and the Reclamation Project Act of <br /> 1939, Section 9(c)(2) (Pub. L. 76-260, 43 U.S.C. 485h(c)); between THE UNITED STATES OF <br /> AMERICA, (United States), represented by the officer executing this Contract, or the duly <br /> appointed successor or authorized representative (Contracting Officer), and OLDCASTLE <br /> SOUTHWEST GROUP, INC. (Contractor) (collectively, Parties). <br /> Recitals: <br /> (a) The United States constructed Blue Mesa Dam and Reservoir as part of the Wayne N. <br /> Aspinall Unit of the Colorado River Storage Project for the purposes of irrigation, municipal, <br /> industrial, and other beneficial uses. <br /> (b) The Contractor requests a water service contract for 2 acre-feet annually of municipal and <br /> industrial(M&I) water from Blue Mesa Reservoir. <br /> (c) The Contractor desires this water supply to augment a depletion of water in the Gunnison <br /> River Basin resulting from gravel pit operations, located in the Nt2 of Section 29 and the <br /> SEA of Section 20, Township 14 South, Range 92 West, 6th P.M., Latitude 38.813417, <br /> Longitude -107.690796. The augmentation plan for the gravel pit is associated with a <br /> Substitute Water Supply Plan with the State of Colorado District Court, Water Court <br /> Division 4. <br /> Page 1 <br />
