EXHIBIT D MINING PLAN (CONT) <br /> 2 and 2A was rerouted to the north side of Phase 2A, which allows <br /> for combining the two phases into one mining phase, and then to <br /> be reclaimed as one reservoir. This does not significantly <br /> affect the Mining or Reclamation Plans, and it actually reduces <br /> reclamation since there is no Phase 2A to backfill . <br /> Phase 3 - Increase acreage by adding 7 . 90 acres for a <br /> conveyor crossing over the transportation corridor that separates <br /> Phase 3 and Phase 4 . An existing dirt road will be used for <br /> access to the area. As the mine has developed, it has been <br /> decided the best way to transport raw material from the eastern <br /> properties of the mine (located on the east side of US Highway <br /> 85) to the Plant Site on the west side of HWY 85 is via an <br /> elevated conveyor system. A 7 . 90 acre conveyor corridor shall be <br /> added between Phases 3 and 4, on properties owned by Cannon Land <br /> Company. There are two Right-of-Ways (ROWs) crossing the Cannon <br /> properties, which are held by the Union Pacific Railroad (UPRR) <br /> and Colorado Department of Transportation (CDOT) for HWY 85 . An <br /> elevated conveyor system will be built to span the ROWS . No <br /> parts of the structure will be placed in the Rights of Ways and <br /> L.G. Everist, Inc (LGE) is working with both ROW owners to get <br /> formal agreements to cross their structures . The agreements will <br /> be filed with the Division when received. If these agreements <br /> are not reached, this corridor will not be used, and the elevated <br /> conveyor system will not be constructed. <br /> With these acreage additions, the permit area will increase by <br /> 26. 62 acres and become 667 . 97 acres more or less . <br /> UNDERDRAIN- Revise reclamation plan to include the underdrain <br /> built between Phase 1 and Phase 2, which was installed in the <br /> summer of 2024 . The underdrain is shown on all amended Map <br /> Exhibits . The underdrain starts in two places - along the <br /> southeast side of Phase 2, and along the northeast side of Phase <br /> 1 . The two sections connect and the underdrain continues between <br /> the north slurry wall of Phase 1 and the south slurry wall of <br /> Phase 2 . The outlet of the underdrain is past the west side of <br /> the phases, near the river. The outlet' s location was what <br /> resulted in a violation due to a small area of disturbance <br /> outside the existing western permit line. The underdrain design <br /> and hydrologic evaluation information was submitted to the <br /> Division during the permit investigation and is included in the <br /> APPENDIX. The underdrain maintains the hydrologic balance and <br /> maintains the groundwater elevation outside the slurry wall to <br /> its historic levels, by allowing the groundwater to seep into and <br /> L.G.
