ROBINS AND LOU ANN ROBINS, AS <br /> JOINT TENANTS WITH RIGHT OF SURVIVORSHIP <br /> AND NOT AS TENANTS IN COMMON <br /> IN CONEJOS COUNTY <br /> REPORT AND RULING OF THE REFEREE <br /> CHANGE OF WATER RIGHTS AND APPROVAL OF PLAN FOR AUGMENTATION <br /> This matter has come before the Court upon the application of Randall L. Robins <br /> and Lou Ann Robins ("Applicants")for a change of water rights and approval of a <br /> plan for augmentation. The application was referred to the water court referee <br /> pursuant to C.R.S. § 37-92-203(7). Having made such investigations as are <br /> necessary to determine whether or not the statements in the application are true, <br /> having consulted with the Division Engineer, and being fully advised with respect to <br /> the subject matter of the application, the Court enters the following findings of fact, <br /> conclusions of law, and ruling of the Referee: <br /> FINDINGS OF FACT <br /> 1. Filing: The Applicants filed an Application for Change of Water Rights and For <br /> Approval of Plan for Augmentation on April 6, 2015. <br /> 2. Notice and Jurisdiction: Timely and adequate notice of the application was <br /> given in the manner required by law. None of the land or water rights involved in the <br /> application are located in a designated groundwater basin. The Court has <br /> jurisdiction over the subject matter of this proceeding and over all persons who have <br /> standing to appear as parties, whether they have appeared or not. <br /> 3. Statements of Opposition: The time for filing statements of opposition expired <br /> on June 30, 2015. A statement of opposition was filed by the Conejos Water <br /> Conservancy District. <br /> 4. Description of Application: The Applicants seek approval to change a portion <br /> of their ownership interest in the Canon Irrigation Ditch from irrigation and domestic <br /> to augmentation by means of recharge. The Applicants further seek approval of a <br /> plan for augmentation to offset groundwater withdrawals from a proposed well that <br /> will furnish water for industrial and commercial use at an existing gravel pit. <br /> 00.55199-5 1 <br />
