2025 Speer Mining Resources SWSP Page 5 of 9 <br /> January 23, 2025 <br /> According to the attached lease extension with Aurora dated November 12, 2024, 91.98 <br /> acre-feet are scheduled to be delivered from the City of Aurora. The Applicant is proposing <br /> to use the excess replacement water from the current lease with Aurora for replacement of <br /> depletions at the Chavers Mining Resources Pit (DRMS M2015-030), which is also operated by <br /> the Applicant. An SWSP for the Chavers Mining Resources was approved on July 25, 2024 and <br /> the plan is conditionally valid through July 31, 2025. The total lagged depletions at Chavers <br /> Mining Resources from the August 1, 2024 through July 31, 2025 period equal 70.47 acre-feet <br /> (with 39.68 acre-feet for the period of January 1, 2025 through July 31, 2025 as shown in <br /> Table 4 from Chavers Mining Resources SWSP). The remaining depletions for the SWSP at the <br /> Chavers Mining Resources site will be covered by excess credits from the 2025 Aurora lease <br /> water used at the Speer Mining Resources Pit site. The attached Table 4 shows the new <br /> delivery schedule for 2025. <br /> Conditions of Approval <br /> This substitute water supply plan is hereby approved in accordance with section 37-90- <br /> 137(11), C.R.S., subject to the following conditions: <br /> 1. This SWSP is approved with an effective date of January 1, 2025 and shall be valid <br /> through December 31, 2025 unless otherwise revoked or superseded by a decree. <br /> If this plan will not be made absolute by a water court action by the plan's expiration <br /> date, a renewal request must be submitted to this office with the statutory fee <br /> (currently $257/DRMS permit) no later than October 1, 2025. <br /> 2. Well permit no. 75688-F was obtained for the current use and exposed pond surface <br /> area of the gravel pit in accordance with section 37-90-137(2) and (11), C.R.S. and <br /> this permit remains valid. <br /> 3. The total surface area of the groundwater exposed at the Speer Pit must not exceed <br /> 1.8 acres for the SWSP period resulting in a maximum evaporation loss of 5.23 acre- <br /> feet. Should the total surface area exposed exceed this amount, an amendment <br /> request must be filed with this office. <br />
