Per our discussion, the Procurement Team agrees that based on the circumstances of the <br /> project, as well as DRMS's SOP for handling these projects, this is not a segregated/split purchase. It also does not <br /> present a need to have the PM approved as the General Contractor as previously suggested.You can go ahead with the <br /> PO for the seed for this project. To summarize our major points on why: <br /> • Seed is bulk ordered for DRMS annually to ensure supply, manage cost, and provide ease for PMs who may need <br /> to make substitutions on a case by case basis, which we agree does not violate Fiscal Rule or Procurement Code <br /> • This specific project was not scheduled at the time of the bulk annual seed purchase <br /> • There was no intent to segregate the purchase to avoid competition, however allowing the contractor to provide <br /> the seed could be detrimental to this project; in addition, it would not be in step with DRMS's SOP for these <br /> purchases. <br /> We agreed to flag and discuss these situations on a case-by-case basis and that the Purchasing Team will confirm to <br /> DRMS that the purchase does not constitute a split purchase and is generally in line with state purchasing guidelines.
