deemed incomplete on October 8, 2010. WFC resubmitted the application on October 22, 2010 <br /> and the DRMS deemed it complete on October 26, 2010. The Division issued its proposed decision <br /> on May 4, 2012. The Division issued the permit on June 20, 2012. <br /> The primary coal seam recovered was the Lower Dakota seam. The Upper Dakota seam was <br /> recovered if it was thick enough and of sufficient quality. The rate of coal production, which <br /> supplied Tri-State Generating and Transmission Association's Nucla Station, was approved to be <br /> 250,000 to 460,000 tons per year. For the years 2014 — 2016, the production averaged 236,565 <br /> tons per year. <br /> On October 3, 2016 the Division approved Succession of Operators Application No. 1. The New <br /> Horizon North Mine was transferred from Western Fuels Colorado to Elk Ridge Mining and <br /> Reclamation (ERMR). <br /> On October 28, 2016,the Division approved Permit Revision No. 1. The revision modified the Haul <br /> Roads, post mining topography, post mining land-use, irrigation designs, culvert locations, and the <br /> stockpile location. <br /> ERMR notified the Division on June 8, 2017 that coal extraction had ceased at the New Horizon <br /> North Mine. The active pit was backfilled and graded in 2018. Coal was transported to the Nucla <br /> Station by contracted haulage trucks over a network of Montrose County roads. The Nucla Station <br /> ceased operation in 2019, and was demolished in 2022. <br /> The C-2010-089 permit was renewed and approved on August 16, 2017 for a 5 year permit term. The <br /> renewal was issued on September 26, 2017. <br /> The Division approved Permit Revision No.2 on February 8,2018. The revision revised a portion <br /> of the post mining land use on the Garvey and Co. property to irrigated pasture/cropland. <br /> Additionally the permit revision revised the topsoil handling plan,revegetation plan and irrigation <br /> design to promote the new post mining land-use. <br /> Bond Release No. 1 was approved on December 17,2018. Phase I, II and III release was granted <br /> for the reclamation of 3 hydrologic monitoring wells that had been plugged and abandoned. <br /> Bond Release No. 2 was approved on July 3, 2019. Phase I release was granted to 120.2 acres <br /> that were backfilled, graded and had drainages re-established in accordance with the approved <br /> reclamation plan. <br /> The Division approved ERMR's application for Permit Renewal No. 2 on April 29, 2022. The <br /> approval of RN-2 granted another 5 year term for the C-201-089 permit. The renewal was issued <br /> on July 7, 2022. <br /> The permit area of the New Horizon North Mine is 231.2 acres. <br /> This Midterm Review is due on December 7, 2024. <br /> New Horizon North Mine -3- 12/6/2024 <br />
