Shults: <br /> <br />On November 22, 2024, the Division of Reclamation, Mining and Safety received your 112c Construction <br />Materials Reclamation Permit Amendment application for the Fort Lupton Sand and Gravel Mine, which is <br />located in Weld County. Preliminary review of the information received determined that the following <br />additional information must be received before the Division can consider your application complete and <br />technical review can begin. Thus, your application is incomplete for the purposes of filing as of December <br />9, 2024. <br /> <br />1. A review of the Colorado Secretary of State’s registered business entity database shows L.G. Everist, <br />Incorporated is listed as delinquent as of September 30, 2024, for failure to file a periodic report. Per <br />the Colorado Corporations and Associations Act, all businesses that conduct activities in Colorado, <br />which includes being an Operator of a mining operation, must register with the CO Secretary of <br />State. Please ensure the company is brought back into compliance and submit evidence of Good <br />Standing with the CO Secretary of State to the Division. <br /> <br />You have sixty (60) days from December 9, 2024, to submit all necessary documents that the Division needs <br />for the application to be considered filed.
