Alameda Parkway, Suite 3600 <br /> Aurora, Colorado 80012 <br /> 303.739.7370 <br /> September 25,2024 <br /> Mr. Ken Schultejann <br /> 120-85 LLC <br /> 10925 E. 120"'Ave. <br /> Henderson,CO 80640 <br /> Re: 120-85 LLC Agreement for Delivery of Reusable Raw Water <br /> Dear Mr. Schultejann: <br /> This letter provides the City of Aurora's consent to continue the above-referenced agreement between the City <br /> of Aurora and 120-85 LLC,dated November 24,2020 ("Agreement")for an Additional Year(November 1, <br /> 2024,through October 31,2025)for delivery of water pursuant to the Delivery Schedule attached to this letter. <br /> This consent is in response to the request from Donna Schultejann representing 120-85 LLC for said <br /> continuance pursuant to the attached Delivery Schedule that modifies the original Delivery Schedule. <br /> Extension of the Agreement for Additional Years is permitted under Paragraph 1 of the Agreement. The <br /> modified Delivery Schedule attached to this letter replaces the Delivery Schedule attached as Exhibit A to the <br /> Agreement. The Unit Rate for the Reusable Raw Water to be delivered under the attached Delivery Schedule <br /> will be $622.00 per acre-foot for 2024 and will increase in 2025 based on any City rate increases. The Effective <br /> Date of the Agreement for the purposes of this Additional Year is the date of this letter.
