COLORADO <br /> Division of Reclamation, <br /> DNR gMining and Safety <br /> Department of Natural Resources <br /> November 5, 2024 <br /> White Wolf Construction & Landscaping, LLC <br /> Bernard(Joe) Montoya <br /> 24541 Highway 12 <br /> Trinidad, CO 81082 <br /> RE: Notice of Board Hearing for Reinstatement of Permit; and the Consideration to <br /> Waive Civil Penalties,White Wolf Construction Borrow Pit, File No. M-2018-029, <br /> MV-2024-020 <br /> Dear Mr. Montoya, <br /> On October 16, 2024, during a hearing of the Mined Land Reclamation Board(MLRB or Board), <br /> White Wolf Construction and Landscaping, LLC (Operator), was ordered to submit verification <br /> of the financial warranty or provide an alternative financial warranty within 30 days of the <br /> effective date of the Boards order. As of October 29, 2024, the Division has found that the <br /> Operator has complied with the Board's order. However, the Board revoked permit number <br /> M-2018-029 during the hearing for the violation (MV-2024-020). The Division has received <br /> your request for permit reinstatement and for the Board to waive the accessed civil penalty. <br /> The Division supports your request and will place the consideration of the request on the Board's <br /> Consent Agenda during the December 11-12, 2024 Board meeting. The Board may not wish to <br /> consider this as a Consent Agenda item, and they may instead consider the matter as a regular <br /> hearing during the Board meeting. The consideration of the Consent Agenda item or a hearing to <br /> consider your request will be held at 1313 Sherman Street, Room 318, Denver, Colorado, <br /> beginning at 9:00 a.m. on December 11th or as soon thereafter as the matter can be considered. <br /> Any information to be considered by the Board during the hearing must be received by the <br /> Division on or before November 29, 2024. <br /> In order to participate in the hearing, all exhibits, materials and witness testimony you wish for <br /> the Board to consider must be submitted via email to the MLRB Administrator, Camie Mojar at: <br /> dnr drms mlrb-submittals(iv,state.co.us, no later than 5:00 PM, November 29, 2024. <br /> If you have good cause not to appear in person you must submit a request to the MLRB to appear <br /> virtually(via ZOOM). To do so, please submit an email to the MLRB Administrator, no later <br /> than 5:00 PM on December 6. 2024 for Board consideration. If approved, you will receive an <br /> authorization code to attend the meeting for this matter. Please note that only Parties and those <br /> who will be testifying may participate in the hearing.
