<br />Section 2.03 Page 2.03-3 December 2021 (RN-02) <br />Legal, Financial, Compliance and Related Information <br /> <br />The New Horizon North Mine (NHN) area is located in the W ½ of Section 25, Township 47 <br />North, Range 16 West of the New Mexico Principal Meridian. A significant portion of the mine <br />permit area corresponds to an area previously permitted by Peabody Coal Company (PCC), in <br />connection with a permit application submitted in April 1980 and approved in May 1993 as Permit <br />No. C-1981-008. Other portions of the NHN permit area were permitted and mined prior to 1973 <br />as a portion of the Navajo and Nucla strip mines which were mined by the Edna Coal Company <br />starting in 1958 and subsequently by PCC until 1992. <br /> <br />PCC submitted an application for the Nucla Mine in April 1981 and Permit No. C-1981-008 was <br />issued by the Colorado Mined Land Reclamation Division in May 1983. The separate Nucla East <br />Mine was incorporated into the permit in 1989. In 1992, the mining permit was transferred to <br />Western Fuels-Colorado (now Elk Ridge Mining and Reclamation, LLC) and the two permit areas <br />were renamed the New Horizon 1 (NH1) and New Horizon 2 (NH2) Mines. All mining at NH1 <br />(formerly the Nucla Mine) was completed by PCC while mining at NH2 (formerly Nucla East) <br />has been conducted solely by Elk Ridge Mining and Reclamation, LLC (Elk Ridge). Map 2.04.3- <br />2 delineates areas previously mined, including “pre-law” disturbance. <br /> <br />The statements below are intended to address the requirements of Section 2.03 of the regulations <br />of the State of Colorado Mined Land Reclamation Board. <br /> <br />2.03.4(2)(a) Identification of Permit Applicant <br /> <br />Elk Ridge Mining and Reclamation, LLC <br />P.O. Other sections of this permit document, maps, figures, attachments, or leases may refer <br />to Western Fuels-Colorado, a Limited Liability Company, Western-Fuels-Colorado, Western <br />Fuels, or WFC. From May 11, 2016 forward these references actually refer to Elk Ridge Mining <br />and Reclamation, LLC. Please see Appendix 2.03.6-1 for a copy of the Tri-State Board Resolution <br />approving the name change from WFC to Elk Ridge. <br /> <br /> <br />
