C-1996-084 for the Lorencito <br /> Canyon Mine should not be suspended or revoked (Order). Following the issuance of this Order, <br /> the Mined Land Reclamation Board("MLRB" or"Board") shall provide an opportunity for a <br /> public hearing pursuant to Rule 5.03.5. Per Rule 5.03.3(3), if within 30 days after service of this <br /> Order the Permittee—New Elk Coal Company, LLC (NECC) files a response to the Order and a <br /> written request for review of the Order, a hearing shall be held as set forth in Rule 5.03.5. If <br /> NECC does not file a response and request a review, the Board shall make a finding of fact and <br /> issue a written decision, and the reasons therefor, concerning suspension or revocation of the <br /> permit. <br /> If a formal request for review of the Order by NECC is requested, a formal hearing shall be held <br /> within 60 days after the Board' s receipt of the request.
