C-1981-012 for the New Elk Mine <br /> should not be suspended or revoked(Order). Following the issuance of this Order, the Mined <br /> Land Reclamation Board ("MLRB" or"Board") shall provide an opportunity for a public <br /> hearing pursuant to Rule 5.03.5. Per Rule 5.03.3(3), if within 30 days after service of this Order <br /> the Permittee—New Elk Coal Company, LLC (NECC) files a response to the Order and a written <br /> request for review of the Order, a hearing shall be held as set forth in Rule 5.03.5. If NECC does <br /> not file a response and request a review, the Board shall make a finding of fact and issue a <br /> written decision, and the reasons therefor, concerning suspension or revocation of the permit. <br /> If a formal request for review of the Order by NECC is requested, a formal hearing shall be held <br /> within 60 days after the Board' s receipt of the request.
