Too� ) <br /> MIDDLE PARK WATER CONSERVANCY DISTRICT <br /> www.middleparkwcd.com <br /> P.O.Box 145,Granby,CO 80446 <br /> (970)725-3460 <br /> September 11, 2024 <br /> Sent nia Email to: <br /> Oldcastle SW Group, Inc. <br /> Attn: Tyra Bartuska, tyra.bartuska&unitedco.com <br /> Dear Ms. Bartuska, <br /> This letter confirms that Oldcastle SW Group, Inc.'s request for short-term augmentation <br /> water from Middle Park Water Conservancy District ("MPWCD") is approved in the amount of 4.0 <br /> acre-feet per year, for use in connection with the operation of the Kattenberg Gravel Pit located East <br /> of Granby.The water requested will be available for two calendar years beginning September 11,2024 <br /> contingent on receipt of payment as set forth in detail below. <br /> As discussed at the regular meeting of the MPWCD Board of Directors on September 11, <br /> 2024, the water for this short-term request will be made available from Windy Gap or Wolford <br /> Mountain Reservoir supplies. In the event of a call on the Fraser River upstream of these sources, <br /> water may be released from MPWCD supplies in Sunset Ridge Pond, only to the extent needed to <br /> meet such call on behalf of Applicant. MPWCD makes no guarantees that water will be available for <br /> release from Sunset Ridge Pond, nor that the water released from any sources listed above will be <br /> suitable for Applicant's uses. In the event of a shortage of supplies in Sunset Ridge Pond, MPWCD <br /> will prioritize releases on behalf of existing permanent MPWCD contractees before any releases will <br /> be made pursuant to this short-term request. <br /> The rate charged for this water will be $1100 per acre-foot for the first year of this request <br /> (total of$4400 for year 1),and $1155 per acre-foot for the second year of this request ($4,620 for year <br /> 2). The full amount of$9,020 is due upon receipt of this letter.A separate invoice for this amount can <br /> be provided by MPWCD if requested. MPWCD acknowledges that the rate charged for this short- <br /> term request is higher than the typical rates charged for contracts that are limited to Windy Gap and <br /> Wolford Mountain supplies only. The higher rate is charged to account for additional administrative <br /> expenses involved with the potential release of water from Sunset Ridge Pond. No refunds will be <br /> provided if water is not ultimately released from Sunset Ridge Pond on behalf of Applicant. <br /> It is the Applicant's responsibility to ensure that this short-term contract will be acceptable to <br /> the Division Engineer to prevent injury to other water rights holders. Furthermore,the Applicant will <br /> be responsible for ensuring that the releases associated with this request are satisfactory to the Division <br /> Page 1 of 2 <br />
