that the Division did not oppose extending the deadline to complete final <br /> reclamation by another five years to provide the Operator with time to meet <br /> Department of Energy requirements and complete reclamation tasks on the sites. <br /> 5. The Operator also provided testimony regarding the state of the sites <br /> and its efforts to comply with federal requirements and that it would need more <br /> time to finish reclamation due to the nature of the federal processes and limited <br /> construction season at the sites. <br /> CONCLUSIONS OF LAW <br /> 1. The Board has jurisdiction over this matter pursuant to the Mined <br /> Land Reclamation Act, Article 32 of Title 34, C.R.S. ("Act"). <br /> 2. Under section 34-32-116(7)(q), C.R.S., all reclamation of a site must be <br /> completed within 5 years from the date an operator has notified the Board that it <br /> has commenced final reclamation. <br /> 3. Section 34-32-112(7), C.R.S., provides that the Board may extend the <br /> 5-year period for completion of final reclamation upon a finding that additional time <br /> is necessary. Operator has demonstrated than an extension is necessary to <br /> complete final reclamation on the sites. <br /> ORDER <br /> Based on the foregoing findings of fact and conclusions of law, the Board <br /> hereby GRANTS the request of Highbury Resources, Inc. for an extension of the <br /> deadline to complete final reclamation for permits M-1977-306, M-1977-310, 1977- <br /> 451, M-1978-116, M-1979-094-HR, M-1984-014.
