4. Following the hearing at the February 21, 2024 meeting, the Board <br /> approved the requested extension of the deadline for reclamation. Through an <br /> order effective May 14, 2024, the Board set October 1, 2024 as the deadline for final <br /> reclamation. <br /> 5. On July 17, 2024, the Operator submitted a request for a hearing <br /> before the Board to extend the reclamation deadline to October 30, 2025, to allow <br /> the Operator to complete requirements imposed by federal regulators. <br /> 6. On July 19, 2024, the Division provided Operator with notice that the <br /> request had been set for a hearing before the Board at its August 21-22, 2024 <br /> meeting. <br /> 7. At the August 21, 2024 Board meeting, the Division provided <br /> testimony regarding the sites and remaining reclamation work for the mines and <br /> the process of dealing with requirements of the U.S. Department of Energy. The <br /> Division did not oppose an extension of the deadline to October 30, 2025 to provide <br /> the Operator with time to complete federal requirements and time during another <br /> construction season to complete final reclamation. <br /> 8. The Operator also provided testimony regarding the state of the sites <br /> and its efforts to comply with U.S. Department of Energy requirements. Much of <br /> the reclamation is completed but further coordination with the Division and the <br /> Department of Energy is necessary to complete the remaining reclamation work. <br /> CONCLUSIONS OF LAW <br /> 1. The Board has jurisdiction over this matter pursuant to the Mined <br /> Land Reclamation Act, Article 32 of Title 34, C.R.S. ("Act"). <br /> 2. Under section 34-32-116(7)(q), C.R.S., all reclamation of a site must be <br /> completed within 5 years from the date an operator has notified the Board that it <br /> has commenced final reclamation. <br /> 3. Section 34-32-112(7), C.R.S., provides that the Board may extend the <br /> 5-year period for completion of final reclamation upon a finding that additional time <br /> is necessary.
